OFFICE MEMORANDUM

Subject: Granting of Annual Increment on retirement: Notional Extension of Supreme Court Verdict in favour similarly placed Non-petitioner employees.

The undersigned is directed to refer to letter dated 07.06.2020 received from the General Secretary/BPMS & Member, JCM-II Level Council (MoD) regarding the above mentioned subject (copy enclosed).

2. In the aforesaid letter, BPMS have referred the judgment dated 11.04.2023 in the case of ‘The Director (Admn and HR) KPTCL & Ors Vs. C.P. Mundinamani & Ors (Civil Appeal No 2471 of 2023, decided on 11.04.2023)’ passed by Hon’ble Supreme Court and requested to extend the benefits of this judgement to all similarly placed non-petitioner employees who have retired in the past and were denied the benefit of annual increment on the ground of their retirement.

3. As DoP&T is the Nodal Agency in the subject mentioned above. Therefore, BPMS letter dated 07.06.2023 is hereby forwarded to DOP&T for consideration. Direction, if any, in this regard may please be intimated to this division.
