Sub: Clarification regarding the Appointing Authority in respect of Artisan Staff In Level-2 for D&AR matters.

In partial modification to this office letter No- ECoR/Pers/R/D&A/37 dated-11.10.2019 in regard to Appointing Authority in respect of Artisan Staff in Level-2, the subject case has been examined in light of MSOP-2018-Sri No-S(NG) (Estt. Matter), RBE No-119/2015 and it is decided that the penalties of Dismissal, Removal or Compulsory retirement under Rule 2(l)(a) of RS (D&A) Rules,1968 are to be imposed only by the higher of the authority which actually appointed the Railway servant to the relevant grade/post or the authority competent to make appointment to that grade/post at the time of imposition of penalty.
Further, Item No. 5 of MSOP-2018 on Establishment Matters to be taken in to consideration in regard to Appointing Authority in respect of Artisan Staff in Level-2.
