Sir,

Federal Executive Meeting of NFPE held an 18th September 2021 through video conference has elaborately discussed the issue of Guidelines of holding of an elective post under Rule 15 (1) (C) of CCs (Conduct) Rules- 1964 under which it has been mentioned that no official can hold any post in any elective body for more than two terms or 5 years whichever is earlier and whosoever intends to be elective as an office bearers in service association has to seek prior permission under rule 15 (1) (C) of CCS (Conduct) Rules – 1964.

After threadbare discussion it has been decided unanimously that as NFPE we are not ready to accept these restrictions on unions as it is clear violation of provisions of CCS (RSA) Rules – 1993, article 309 and clause (5) of article 148 of the Constitution and CCS (RSA) Rules-1993, nowhere such types of restrictions are mentioned.

Since 1993 after implementation of CCS (RSA) Rules – several rounds of membership verification have taken place and the Federations and Unions are functioning smoothly. Now what has compelled the administration to put these restrictions. It smacks something else. It is an attack on trade unions to not allow them to function democratically.

Rules 15 (1) (C) of CCS (Conduct) Rules – 1993 is about private trade or employment. Service unions/associations do not come under purview of this rule. It is a misinterpretation of the said rule and linking the unions with any elective body is not correct. Putting one more conditions to seek prior permission to be elected as union office bearers from the competent authority is nothing but undue interference of administration in internal organizational matters of the unions.

Therefore such restrictions cannot be accepted.

We strongly oppose these rules and request to kindly revisit in to this matter and withdraw the orders issued under letter referred above so that the congenial environment in the Department may be maintained, failing which we as NFPE shall be compelled to launch agitational programmes countrywide culminating in to strike and we will not-co-operate the Department further to achieve the business targets of IPPB and other new schemes.
