OFFICE MEMORANDUM
Subject: Entitlement on resignation from Government Service in respect of Central Government employees opted for Unified Pension Scheme under NPS -reg.
The undersigned is directed to say that Department of Pension and Pensioners’ Welfare has notified the Central Civil Services (Implementation of Unified Pension Scheme under the National Pension System) Rules, 2025 to govern the service related matters of Central Government civil employees covered under the Unified Pension Scheme (UPS).
(2). Rule 15 of these rules provides for entitlement on resignation from Government service of a Central Government servant opted for Unified Pension Scheme (UPS) under the National Pension System (NPS). The rule provides that on resignation from a Government service or a post, unless it is allowed to be withdrawn in the public interest by the appointing authority, entails forfeiture of assured payout under the Unified Pension Scheme. In such cases, the accumulated pension wealth in the individual corpus shall be payable to the subscriber in lump sum in accordance with the regulations as notified by the Authority.
(3). Such payment of lump sum amount to subscriber shall not be made before the expiry of a period of ninety days from the date on which the resignation becomes effective and the subscriber is relieved of his duty.
(4). However, if the subscriber dies before the expiry of a period of ninety days from the date on which the resignation becomes effective, accumulated pension wealth in the individual corpus shall be made to the legally wedded spouse and in case legally wedded spouse does not exists, the same would be payable to the legal heir(s), in accordance with the regulations as notified by the Authority.
(5). All Ministries/‘Departments are requested that the above provisions regarding entitlement on resignation from Government service of a Central Government servant opted for UPS under NPS may be brought to the notice of the personnel dealing with the UPS / NPS matters of employees in the Ministry/Department and attached/subordinate offices thereunder, for strict implementation.
