OFFICE MEMORANDUM

Subject: Alternate nomination, cancellation, alteration and invalidation of nomination under the General Provident Fund (Central Services) Rules, 1960 – reg.

The undersigned is directed to say that this Department has been receiving references seeking clarification on the procedure for payment of the balance standing to the credit of a GPF subscriber in the event of the death of a nominee, changes in family circumstances and the date on which a nomination takes effect.

2.      In this connection, Rule 5 permits a subscriber to specify that, if a nominee predeceases the subscriber, the right of that nominee shall pass to another specified person or persons. Such alternate nomination must comply with the family restriction prescribed under Rule 5, wherever applicable.

3.      A subscriber is permitted to cancel a nomination at any time by a written notice to the Accounts Officer. The subscriber shall send a fresh nomination in accordance with the rules either along with that notice or separately. A nomination or cancellation takes effect from the date on which it is received by the Accounts Officer.

4.      Where a nominee dies before the subscriber, a valid nomination in favour of an alternate nominee under Rule 5(5)(a) may operate. If no such provision exists, Rule 5(6) requires the subscriber to make a fresh nomination immediately.

5.      Under Rule 5(5)(b) a subscriber may provide in a nomination form that the nomination shall become invalid in the event of the happening of a contingency specified therein.

6.      The proviso to Rule 5(5) governs the specified case where the subscriber had only one family member while making the nomination. In such a case, the right of the alternate nominee becomes invalid on subsequent acquisition of additional family member(s).

7.      All Ministries/Departments are requested to ensure that subscribers are advised to submit a fresh valid nomination when a nominee dies or family circumstances change.

8.      This issues with the approval of the competent authority.
