NOTIFICATION

No.10-4/2021-U3(A): Whereas, the Central Government is empowered under Section 3 of the University Grants Commission (UGC) Act, 1956 to declare, on the advice of the UGC, an institution of higher learning as an Institution deemed to be University.

2. And whereas, in exercise of the powers conferred by Section 3 of the UGC Act, 1956, the Central Government, vide Notification No. 9-13/2007-U.3(A) dated 4th June, 2008, on the advice of UGC, had declared Nitte University, Mangalore, Karnataka consisting of A.B. Shetty memorial Institute of Dental Sciences as an Institution Deemed to be University. Further, pursuant to the judgment Order dated 03.11.2017 in Civil Appeal Nos. 17869-17870/2017 titled as Orissa Lift Irrigation Corp. Ltd Versus Rabi Sankar Patro & Ors. and Civil Appeal Nos. 17902-17905/2017 titled as Vijay Kumar & Ors Vs. Kartar Singh & Ors held, the name of deemed to be University was changed from ‘Nitte University’ to ‘Nitte’ by deleting the word University.

And further whereas, Nitte (Deemed to be University), Mangalore, Karnataka uploaded online application dated 04.08.2021 on UGC Portal for starting of an off-Campus centreat Nitte Village, Udupi District, Karnataka comprising two Colleges namely Dr. Nitte Shankara Adyanthaya Memorial First Grade College (NSAMFCC), Udupi and Nitte Mahalinga Adyanthaya Memorial Institute of Technology (NMAMIT), Nitte, Karnataka. The UGC was asked to examine the application as per the UGC (Institutions Deemed to be Universities) Regulations, 2019 and furnish its advice.

And whereas, UGC conveyed that the application of the deemed to be University was examined through an Expert Committee consisting of the nominee of All India Council for Technical Education (AICTE). The report of the Expert Committee was considered by the Commission in its 553rd meeting held on 26.10.2021 in which the following was resolved:

“The Commission considered the report of the UGC Expert Committee and resolved  to recommend approval of Off-Campus Centre of Nitte (Deemed to be University), Mangaluru (Karnataka) at Nitte Village, Udupi Dt. Karnataka keeping in view the NAAC grading (A+ CGPA 3.40) and NIRF ranking, 2021 (77th in Universities category) of the Deemed to be University. The recommendations are in tune with the National Education Policy wherein the overall culture of empowerment & graded autonomy to higher educational Institutions and gradually phasing out the system of affiliating colleges is visualized. However, the functioning of the off-campus shall be reviewed us per the provisions of UGC Regulations. The Deemed to be University should ensure that the standard in the off-campus are maintained similar to the main campus and all the UGC Rules and Regulations are followed strictly”.

5. And whereas, the advice of the Commission was considered in the Ministry and decided to issue Letter of Intent (Lol) for fulfilment of certain conditions. Accordingly, Ministry issued Lol on 12.01.2022 for fulfilment of the following conditions within a period of three years:

  1. Nitte, Karnataka shall submit a certificate regarding disaffiliation of Dr. Nitte Shankara Adyanthaya Memorial First Grade College (NSAMFGC), Udupi and Nitte Mahalinga Adyanthaya Memorial Institute of Technology (NMAMIT) from Mangalore University and Visvesvaraya Technological University respectively.
  2. Nitte, Karnataka shall submit the declaration that will be to the extent that the students already enrolled will continue and complete their degree from their respective affiliated University.
  3. Nitte, Karnataka shall submit the declaration that will be to the extent that the existing infrastructure will either be transferred or new infrastructure will be created as may be required for setting up an Off-Campus.
  4. The Nitte, Karnataka shall submit a letter of maintaining corpus fund of Rs. 10.00 Crore as per the UGC Regulations, 2019.
  5. The Nitte, Karnataka shall submit a certificate regarding maintaining of cadre ratio of faculty, as recommended by AICTE/UGC.

6. And further whereas, the compliance report in respect of conditions of Lol, as submitted by the deemed to be University, was verified by the UGC. UGC informed that the deemed to be University has fulfilled the conditions of the Lol and the same is approved by the Chairman, UGC.

7. Now, therefore, in exercise of the powers conferred by Section 3 of the UCC Act, 1956, the Central Government, on the advice of the UGC, do hereby permit Nitte (Deemed to be University), Mangalore, Karnataka for starting of an off-campus centre at Nitte Village, Udupi District, Karnataka subject to submission of fulfilment report of the following conditions:

  1. The existing infrastructure of Dr. Nitte Shankara Adyanthaya Memorial First Grade College (NSAMFGC), Udupi and Nitte Mahalinga Adyanthaya Memorial Institute of Technology (NMAMIT) will either be transferred or new infrastructure will be created as may be required for setting up an Off-Campus.
  2. Report of maintaining cadre ratio of faculty, as recommended by AICTE/UGC.
  3. The students already enrolled will continue and complete their degree from their respective affiliated University.

8. The said off-campus shall be reviewed by the Commission after a period of five years from the date of Notification by the Government. This permission is subject to the compliance of the UGC (Institutions Deemed to be Universities) Regulations, 2019 and other relevant Norms / Rules / Regulations / Directions issued by the Central Government, UGC and other Statutory Councils, from time to time.
