2 फरवरी 2026 को लोकसभा में शिक्षा राज्य मंत्री श्री जयंत चौधरी ने एक अतारांकित प्रश्न का उत्तर देते हुए स्पष्ट किया कि शिक्षा समवर्ती सूची का विषय होने से शिक्षक भर्ती, पेंशन जैसी सेवा शर्तें और संबंधित अदालती मामले मुख्य रूप से राज्यों/केंद्रशासित प्रदेशों के अधिकार क्षेत्र में आते हैं। केंद्र सरकार स्वायत्त बोर्डों के माध्यम से समयबद्ध पारदर्शी भर्ती की सलाह देती है और समग्र शिक्षा योजना के तहत वित्तीय सहायता, DIKSHA जैसे आईसीटी उपकरणों तथा शैक्षणिक संसाधनों से स्टाफ की कमी का समाधान करता है। केंद्रीय या राज्य शिक्षकों के लिए पुरानी पेंशन योजना (ओपीएस) बहाल करने का कोई प्रस्ताव लम्बित नहीं है। केन्द्रीय विद्यालयों के 2004 से पहले भर्ती कर्मचारी सीसीएस पेंशन नियम 1972 का पालन करते हैं जबकि उसके बाद एनपीएस में आते हैं, तथा नवोदय विद्यालयों में 2004 से पहले सीपीएफ (2009 के बाद एनपीएस अनिवार्य, बीच में विकल्प) लागू है।

(a) whether the Government proposes to restore the old pension schemes for teachers at the centre and in the States/UTs, if so, the details thereof and if not, the reasons therefor;
(b) the details of the main reasons for pending appointments of teachers, stalled joining of teachers and selected candidates not getting appointment despite advertised post in various States/UTs; and
(c) the current status of recruitment of 69,000 assistant teachers in Uttar Pradesh along with the number of candidates appointed so far and the number of cases pending in court or the department?

(a) to (c): Education being a subject in the Concurrent List of the Constitution, an overwhelming majority of schools in the country are under the administrative control of the respective State Governments and Union Territory Administrations. Accordingly, matters relating to recruitment, service conditions, including pensionary benefits, deployment of teachers, and court cases arising therefrom fall primarily within the administrative domain of the concerned State Governments/UT Administrations. Therefore, issues relating to pending appointments of teachers, delayed joining of teachers, and non-appointment of selected candidates against advertised posts in various States/UTs are dealt with by the respective State Governments/UT Administrations.
The Government of India periodically advises the States/UTs to fill up vacant posts of teachers and to ensure timely recruitment through transparent and merit-based processes, including recruitment through autonomous teacher recruitment boards or similar bodies. The progress relating to filling up of teacher vacancies through competitive selection examinations conducted by the States/UTs, with due regard to consistency, sanctity and after undertaking technology-based comprehensive teacher requirement planning and forecasting exercises, is reviewed periodically through regular meetings with States/UTs as well as through advisories.
Further, under the Centrally Sponsored Scheme of Samagra Shiksha, the Central Government provides financial assistance to States/UTs for maintaining appropriate Pupil—Teacher Ratios (PTR) and for teacher-related interventions, including in-service training, teacher capacity building, and institutional academic support through SCERTs, DIETs, BRCs and CRCs.
The Department also supports States/UTs in the adoption of ICT platforms such as DIKSHA and PM e-VIDYA, and in strengthening cluster-level academic support through BRCs and CRCs, to provide on-demand resources and pedagogical support to teachers and to mitigate, to the extent possible, the academic impact arising from staff shortages.
The pensionary benefits of employees of the Kendriya Vidyalaya Sangathan (KVS), which functions under the Central Government, are governed by the Central Civil Services (Pension) Rules, 1972, as amended from time to time, in respect of employees who joined KVS service up to 31.12.2003. Employees who joined the Kendriya Vidyalaya Sangathan on or after 01.01.2004 are covered under the National Pension System (NPS).
In respect of the Navodaya Vidyalaya Samiti (NVS), employees who joined service prior to 01.01.2004 are governed by the Contributory Provident Fund (CPF) scheme. Employees who joined the Navodaya Vidyalaya Samiti on or after 01.04.2009 are mandatorily covered under the New Pension Scheme (NPS). Employees who joined between 01.01.2004 and 01.04.2009 were provided a one-time option to choose between the CPF and NPS schemes. While a few employees opted for the NPS, the majority exercised the option for the CPF scheme. At present, employees of the Navodaya Vidyalaya Samiti are covered either under the Contributory Provident Fund (CPF) scheme or the New Pension Scheme (NPS), as applicable.
The Government of Uttar Pradesh has informed that, in respect of the recruitment of 69,000 Assistant Teachers, a Special Leave Petition (Diary No. 38554/2024) titled Ravi Kumar Saxena & Others vs. State of Uttar Pradesh & Others has been filed before the Hon’ ble Supreme Court against the order dated 13.08.2024 passed in Special Appeal No. 172/2023 (Mahendra Pal & Others vs. State of Uttar Pradesh & Others) and other connected special appeals, which arose out of the order dated 13.03.2023 passed in Writ Petition No. 13156/2020 (Mahendra Pal & Others vs. State of Uttar Pradesh & Others) and other connected petitions before the Hon’ble Allahabad High Court, Lucknow Bench.
