Sub: Promotion of a Railway Servant against whom prosecution for a criminal charge is pending before a Court of Law – clarification regarding.
Ref: ECoR’s letter No. ECoR/Pers/Confdl/NG/Stores/2026 dated 23.07.2026.
Para 2 of Board’s instructions issued vide letter No. E(D&A)92 RG6-149(A) dated 21.1.1993 (RBE No. 13/93) stipulates that the sealed cover procedure provided therein shall be applicable, inter-alia, to Railway servants in respect of whom prosecution for a criminal charge is pending. The enumerated procedure would continue until the conclusion of the relevant proceedings.
2. Attention in this regard is also invited to para 4 of these instructions which envisages that all efforts to finalise the proceedings expeditiously should be taken so that the need for holding back the promotion is limited to the barest minimum. However, in cases where the proceedings are not concluded even after expiry of 2 years from the date of original selection/formation of suitability list, para 5 thereof provides that the Promoting Authority may review the case to consider the desirability of giving the Railway servant an ad-hoc promotion keeping in view certain aspects provided therein.
3. Railway may please take necessary action in the light of the position above.
