COMMUNICATION REGARDING OPS FOR CENTRAL GOVERNMENT EMPLOYEES

Will the PRIME MINISTER be pleased to state:
(a) whether DoP&PW had sent a reference/note to Department of Expenditure (DoE) during August, 2022 for concurrence/comments of DoE for issuing general executive orders providing coverage of Central Government servants under Old Pension Scheme who were appointed on or after 01/01/2004 on the basis of advertisements for recruitment prior to 01/01/2004;
(b) if so, the details thereof;
(c) whether DoE has sent back the reference with some queries in October, 2022;
(d) if so, the details thereof;
(e) the details of response furnished by DoP&PW to DoE against the queries; and
(f) effort being made to obtain concurrence in time bound manner and to expedite general orders?
ANSWER

(a) to (f): After dismissal of some of SLPs / Review Petitions by Hon’ble Supreme Court filed by Union of India against the orders of Hon’ble High Court of Delhi allowing benefit of old pension scheme to those Government servants whose selection process was completed after 01.01.2004, a reference was made to Department of Expenditure in August, 2022 on the question of issue of general order in this regard. Department of Expenditure furnished their comments in October, 2022 on the reference made in August, 2022 by this Department.
There is no decision to issue general instructions in this regard.
National Pension System (NPS) was introduced for Central Government employees by a Notification of Ministry of Finance (Department of Economic Affairs) dated 22nd December, 2003. NPS is mandatory for all new recruits to the Central Government service from 1st January, 2004 (except the armed forces).
In view of the specific provisions of the Notification dated 22.12.2003, the date of advertisement for the vacancies is not considered relevant for determining the eligibility for coverage under the Old Pension Scheme or the National Pension System.

क्या प्रधानमंत्री यह बताने की कृपा करेंगे कि:
(क) क्या पेंशन और पेंशनभोगी कल्याण विभाग ने अगस्त, 2022 के दौरान व्यय विभाग (डीओई) को 01/01/2004 के पूर्व जारी किए गए भर्ती संबंधी विज्ञापनों के आधार पर पुरानी पेंशन योजना के तहत केंद्र सरकार के उन कर्मचारियों जिन्हें 01/01/2004 के पूर्व या बाद में नियुक्त किया गया था, को कवरेज प्रदान करने वाले सामान्य कार्यकारी आदेश जारी करने के लिए व्यय विभाग की सहमति/टिप्पणी के लिए एक संदर्भानोट भेजा था;
(ख) यदि हां, तो तत्संबंधी ब्यौरा क्या है; द द
(ग) क्या डीओई ने उक्त संदभ को अक्टूबर, 2022 में कुछ प्रश्नों के साथ वापस भेज दिया है;
(घ) यदि हां, तो तत्संबंधी ब्यौरा क्या है;
(ड.) उक्त प्रश्नों के संबंध में पेंशन और पेंशनभोगी कल्याण विभाग द्वारा डीओई को प्रस्तुत की गई प्रतिक्रिया का ब्यौरा क्या है; और
(च) समयबदध तरीके से सहमति प्राप्त करने और सामान्य आवेशों में तेजी लाने के लिए क्या-क्या प्रयास किए जा रहे है?

(क) से (च) माननीय दिल्ली उच्च न्यायालय के आदेशों के विरुद्ध भारत संघ द्वारा दायर किए गए कुछ एसएलपी/समीक्षा याचिकाओं को माननीय सर्वोच्च न्यायालय द्वारा खारिज करने के बाद, उन सरकारी कर्मचारियों को, जिनकी चयन प्रक्रिया 01.01.2004 के बाद पूरी हुई थी, पुरानी पेंशन योजना का लाभ देने की अनुमति देने के संबंध में सामान्य आदेश जारी करने के लिए, व्यय विभाग को अगस्त, 2022 में एक संदर्भ भेजा गया था। इस विभाग द्वारा अगस्त, 2022 में भेजे गए संदर्भ पर व्यय विभाग ने अक्टूबर, 2022 में अपनी टिप्पणियां भेजी हैं।
इस संबंध में सामान्य निर्देश जारी करने का कोई निर्णय नहीं लिया गया है।
वित्त मंत्रालय(आर्थिक कार्य विभाग) के दिनांक 22 दिसंबर, 2003 की अधिसूचना द्वारा केंद्र सरकार के कर्मचारियों के लिए राष्ट्रीय पेंशन प्रणाली(राष्ट्रीय पेंशन प्रणाली) को लागू किया गया था। दिनांक 01 जनवरी, 2004 से केंद्र सरकार सेवा में सभी नई भर्तियों(सशस्त्र सेनाएं को छोड़कर) के लिए राष्ट्रीय पेंशन प्रणाली अनिवार्य है।
दिनांक 22.12.2003 की अधिसूचना के विशिष्ट उपबंधों को ध्यान में रखते हुए, पुरानी पेंशन योजना या राष्ट्रीय पेंशन प्रणाली के अंतर्गत कवर करने के लिए पात्रता निर्धारित करने के लिए रिक्तियों के लिए दिए गए विज्ञापन की तारीख को सुसंगत नहीं माना जाता है।
