CIRCULAR

The Government has issued the Public Procurement (Preference to Make in India) [PPP-MII] Order, 2017, vide Department for Promotion of Industry and Internal Trade (DPIIT) Order No. P-45021/2/2017-B.E.-II dated 15.06.2017, along with subsequent revisions, to promote domestic manufacturing and to encourage the production of goods and services in India with the broader objective of enhancing income and employment. Additionally, the Government has also notified several technical regulations inter alia including “Electronics and IT Goods (Requirements for Compulsory Registration) Order, 2021”, “Mandatory Testing and Certification of Telecom Equipment (MTCTE)” and various other Quality Control Orders (QCOs) to ensure safety, security and other public interest requirements.

2. It is reiterated that goods procured under the PPP-MII framework must comply with all the applicable regulatory requirements of the country. However, instances have been observed where the items supplied differ from the models approved under the respective regulations. While the regulatory authorities undertake surveillance to assess ‘market. compliance, public procurement requires additional diligence to ensure that only conforming products are accepted.

3. Accordingly, the Procuring agencies must ensure that products supplied under PPP-MII meet the specifications claimed by the supplier and conform to the relevant regulatory requirements and any other conditions notified under the PPO. For the same, the Procuring agencies may consider inserting appropriate requirements in the procurement contracts/tender documents that the Procuring agencies may undertake third party testing and verification of the products at any stage of the procurement’ process/after completion of procurement. They may introduce suitable penal clauses in the procurement contracts/tender documents to address non-compliance issues. Further, in case non-compliance to the regulatory requirements is found, they are advised to inform the relevant nodal ministry.

5. All procuring entities are requested to follow the aforesaid instructions while undertaking procurement activities under the Public Procurement (Preference to Make in India) framework.

6. This issues with the approval of the Competent Authority.
